Synopsis

The Department of Planning and Development is composed of the Administration, Planning, and Development Divisions, along with two other Divisions recently transferred into the Department: Strategic Infrastructure Planning and Economic Analysis. The Department of Planning and Development provides the following:

  • Preparation of recommendations for use by the Planning Commission and Board of Commissioners concerning rezonings and special use permit applications received by the Department, including the legal advertisements and public notifications regarding these applications
  • Preparation and update of the County's Land Use Plan and Unified Plan
  • Maintenance of the official records and minutes of the Planning Commission
  • Maintenance of records pertaining to, and review/approval of, plans, rezonings, special use permits, development permits, building permits, sign permits, development regulation waiver/modification requests, zoning variances, and minutes of the Zoning Board of Appeals, the Board of Construction Adjustments and Appeals, the Development Advisory Committee, and the Tree Advisory Committee
  • Regulation and inspection of land development for compliance with development regulations; enforcement of the Zoning Resolution to include review of building and site plans; inspection of buildings, structures and site areas, issuance of applicable permits; regulatory coordination with regional, state and federal agencies; and assignment of street addresses
  • Regulation and inspection of buildings and structures for compliance with building, electrical, plumbing, mechanical, and other codes
  • Provision of information regarding setbacks, buffer requirements, uses in zoning districts and conditions of zoning
  • Development and maintenance of data sources, such as demographics, economic forecasts, land use, zoning activity; making that data available to the public through reports and maps


The License and Revenue section (formerly located within the Finance Department) has been combined with building permits section and issues occupation tax certificates (business licenses) for businesses located in unincorporated Gwinnett County

The Division of Strategic Infrastructure Planning is responsible for developing the Water and Wastewater Master Plan and ensuring that capital projects continue to be planned, designed, and constructed in accordance with that plan; maintains the hydraulic models of both the water and wastewater systems; and, is the principal interface with other local, state, and regional planning entities to assure coordinated planning efforts within the region and compliance with regulatory requirements

The Economic Analysis Division prepares short- and long-range revenue forecasts; monitors demographics and economic conditions and trends; maintains indicators used for forecasting and decision-making; assesses economic and financial impact of proposed actions; provides basic research and analysis for economic, financial, and related issues; assists in monitoring the economic and fiscal impact of proposed legislation; implements the County's Economic Development program; and administers the County Redevelopment Program and Tax Allocation Districts

Authorities and Boards

Development Advisory Committee
The Development Advisory Committee consists of 21 members representing various interest groups appointed by the Board of Commissioners. Members serve staggered two-year terms. The committee meets on the third Wednesday of each month. The Development Advisory Committee was established for the following purposes:

  • Advise the Board of Commissioners and the Department of Planning and Development on issues and matters of concern with regard to land development activities and regulations
  • Assist the Department of Planning and Development in the interpretation and implementation of land development regulations
  • Review newly proposed land development regulations and amendments and advise the Department of Planning and Development and the Board of Commissioners on their impact and effectiveness
  • Carry out such studies or investigations regarding the land development regulatory process or requirements as the Board of Commissioners may request from time to time

Gwinnett County Planning Commission
The Gwinnett County Planning Commission consists of nine County-appointed members. The Commission Chairman appoints one member and each District Commissioner appoints two members. Members are appointed annually. The Planning Commissioners serve at the will of the Board of Commissioners and may be replaced at any time. The Gwinnett County Planning Commission was established for the following purposes:

  • Research, review, and make recommendations to the Board of Commissioners on zoning, the Zoning Resolution, zoning map amendments, special use permits, waivers of the development regulations, the Unified Plan, development regulations, and other policies and procedures of the Planning and Development Department
  • Advise the Board of Commissioners on environmental, public health, safety, and general welfare matters, which may include infrastructure, historic, business, residential, and recreational matters, policies, and procedures
  • Engage with various public and private organizations and agencies engaged in or interested in planning and development activities so as to provide leadership in identifying and implementing County objectives for planning and development
  • Assist the Planning and Development Department, other County departments, boards and authorities, and the Board of Commissioners in carrying out their various functions by making recommendations to achieve the desired benefits on behalf of present and future Gwinnett County residents and businesses as a whole
  • Report to the Board of Commissioners after research and review on matters referred by the Board, prior to the Board taking action

The Planning Commission holds public hearings on the first and third Tuesday of each month at 7:00pm in the Gwinnett Justice and Administration Center auditorium. Typically, the first meeting is held to hear rezoning cases, and the second to handle Special Use Permit applications and other various case types.

Tree Advisory Committee
The Tree Advisory Committee (TAC) consists of nine members appointed by the Board of Commissioners for staggered two-year terms. The committee meets on the first Monday of each month. The TAC was established by the Board of Commissioners in October 1999 for the following purposes:

  • Advise the Board of Commissioners and the Department of Planning and Development about issues and matters of concern regarding the preservation and replacement of trees
  • Assist the Department of Planning and Development in the interpretation and implementation of the Buffer, Landscape, and Tree Ordinance
  • Review proposed new regulations and amendments to the Buffer, Landscape, and Tree Ordinance and advise the Department of Planning and Development and the Board of Commissioners about their impact and effectiveness
  • Establish educational and other programs to encourage proper management and maintenance of trees in the unincorporated areas of the county
  • Conduct studies or investigations regarding trees and the land development process as requested by the Board of Commissioners from time to time

The Tree Advisory Committee played an important role in the update of the Buffer, Landscape, and Tree Ordinance that became effective on December 11, 2007. Regulations were amended to include specimen tree preservation, additional planting requirements for subdivision developments, and a requirement to provide a tree canopy calculation for all developments. The tree canopy calculation will assist in determining existing canopy coverage in anticipation of a future Buffer, Landscape, and Tree Ordinance amendment to utilize tree canopy as a mechanism for tree preservation/replacement.

To facilitate understanding of new regulations, an illustrated handbook was created to accompany the ordinance. This handbook is currently being revised to include adopted amendments to the Buffer, Landscape, and Tree Ordinance.

Zoning Board of Appeals
The Zoning Board of Appeals consists of five members who are appointed for one-year terms by the Board of Commissioners. The Zoning Board of Appeals meets on the second Tuesday of every month at the Gwinnett County Justice and Administration Center auditorium. The Zoning Board of Appeals was established for the following purposes:

  • Authorize, upon appeal in specific cases, such variances from the terms of the Zoning Resolution as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the Zoning Resolution will result in unnecessary hardship. Such variances may be granted in such individual cases of unnecessary hardship upon a finding by the Zoning Board of Appeals that:
  • a. There are extraordinary and exceptional conditions pertaining to the particular property in question because of its size, shape, or topography
  • b. The application of the resolution to this particular piece of property would create an unnecessary hardship
  • c. Such conditions are peculiar to the particular piece of property involved
  • d. Such conditions are not the result of any actions of the property owner
  • e. Relief, if granted, would not cause substantial detriment to the public good nor impair the purposes or intent to this resolution
  • Hear and decide appeals when it is alleged there is error in any order, requirement, decision or determination made by the Department of Planning and Development in the enforcement of this Zoning Resolution
  • Handle and determine the appropriate actions on requests for Special Exceptions to the Zoning Resolution. The Zoning Board of Appeals, however, cannot grant a variance for a use of land, building, or structure that is prohibited by the Land Use Resolution or which would result in a greater intensity of development on a property than would otherwise be allowed if no variance were involved

The Zoning Board of Appeals meets the second Tuesday of each month at 6:30pm in the Gwinnett Justice and Administration Center auditorium.

Board of Construction Adjustments and Appeals
This board consists of eight members, including representatives from the general public, heating and air conditioning, electrical, building, plumbing, architectural, civil engineering, and fire protection engineering trades. These members are appointed by the Board of Commissioners and serve staggered two-year terms.

The Board of Construction Adjustments and Appeals reviews appeals made by individuals concerning the interpretation and administration of the Accessibility Code, the Building Code, the Electrical Code, the Gas Code, the Life Safety Code, the Mechanical Code, the Plumbing Code, and the Residential Code as adopted by the state of Georgia.

In addition, this board reviews proposed changes to these codes, approves third-party inspectors, and makes relevant recommendations to the Board of Commissioners.

Board meetings are held the second Wednesday of each month.

Licensing and Revenue Board of Appeals

The Licensing Revenue Board of Appeals was established pursuant to the County Alcoholic Beverage Ordinance. The Alcoholic Beverage Appeal Board and the Municipal-Gwinnett Business License Tax Rate Review and Appeal Committee have been combined to form this Board. The Board consists of five members, appointed as follows:

  • Planning and Development Director, or designee
  • Director of Board of Health, or designee
  • A member of the Gwinnett Convention and Visitors Bureau Board to be named by the GCVB
  • A resident of Gwinnett County appointed by the Board of Commissioners
  • A resident of Gwinnett County to be named by the Grand Jury

The Licensing and Revenue Board of Appeals members serve two-year terms, with the exception of the Planning & Development Director and the Director of the Board of Health.

Responsibilities of this Board include:

  • To provide an appeal process for business owners who have been denied an occupation tax certificate, had their occupation tax certificate suspended or revoked, deems the tax to be unlawful, discriminatory or inequitable or to any person who has been denied an employee work permit
  • To provide an appeal process for cases dealing with the denial of an alcohol license or a permit to service alcohol, or the suspension or revocation of an alcohol license
  • To provide an appeal process for business owners who have been denied an adult entertainment license, had their adult entertainment license suspended or revoked, or have been denied an adult entertainment work permit
  • To provide an appeal process for business owners who have been denied a massage/spa establishment license, had their massage/spa establishments license suspended or revoked, or have been denied a massage/spa work permit


Strategic Objectives

Develop and implement a Unified Development Ordinance

The 2030 Unified Plan, which is a long-range comprehensive planning document comprised of the County's Comprehensive Plan, the Consolidated Plan, and the Comprehensive Transportation Plan, was adopted by the Board of Commissioners in April 2009.

Several strategies for implementation of the Unified Plan are underway. The Department of Planning and Development is in the process of award of a RFP for the Provision of a Unified Development Ordinance. This effort will consolidate and align all development ordinances, policies, and documents into one easy to read document to further streamline the development process in the County and to ensure compatibility with the Unified Plan. This project will also include the development of the first two Character Area Sector Plans which will provide land use recommendations at a more detailed level for two of the character areas identified in the Unified Plan (the Research and Development Corridor along Highway 316 and the Rural Estate Housing Area in eastern Gwinnett County).

This project is anticipated to commence in mid-October of 2010 and be completed and ready for Board of Commissioners approval by first quarter 2012.

Consolidate the long-range planning activities related to infrastructure for the County within the Department of Planning & Development.

During FY 2010, staffing changes were implemented in order to provide more efficient and effective long-range planning for various aspects of County government. This organizational change will ensure greater compatibility with the 2030 Unified Plan. The planning for water and wastewater infrastructure is now performed within the Department of Planning and Development and the Department remains in closer communication with the Department of Transportation regarding planning for transportation and transit infrastructure.  Also with the Department of Community Services regarding planning for parks and recreational facilities, and has a member on the newly formed ARTWORKS Board to promote and support the arts community in alignment with the 2030 Unified Plan.

A Water and Wastewater Master Plan is currently underway which will provide guidance to the Department of Water Resources regarding infrastructure policies and capital needs in alignment with the 2030 Unified Plan.

Implement digital technology to enhance customer service and staff efficiency:

  • Utilize an advanced permit database management system, Accela, for production including a Citizens Access module for effective online search for specific information of interest  
  • Automate the plan review process with ProjectDox software for online electronic submittal and review of documents for permitting

 

Expand the features for the departmental permit database management system, Accela, to provide customers the option to obtain permits online for minor upgrades and repairs on electrical, mechanical, and plumbing components and systems

Ensure accurate enforcement of codes, ordinances and regulations:

  • Gwinnett County is committed to provide highly accurate and thorough plan review and inspection services which aid in ensuring that site development and construction projects consistently comply with the applicable codes, ordinances, and regulations
  • Quality assurance review is performed on a representative number of construction projects submitted for permit to verify the accuracy of work completed by plan review and inspections staff with regard to enforcing the requirements for conditions of zoning and special use permit, and overlay districts
  • Quality assurance review is performed on a representative number of construction projects submitted for permit to verify the accuracy of work completed by plan review staff with regard to enforcing the life safety, fire prevention, and construction codes
  • Quality assurance review is performed on a representative number of site development projects submitted for permit to verify the accuracy of work completed by plan review staff with regard to enforcing the ordinances and regulations applicable to site development, water and sewer facilities and systems, and stormwater facilities and systems
  • Building and Fire Plan Review staff participate in a cross-training program to enhance technical skills for identifying crucial code compliance deficiencies in related areas of code enforcement beyond the primary scope of expertise

Bryan is a professional engineer who started working at Gwinnett County in 1995 after graduating from the University of Georgia. He started as a stormwater and drainage engineer and by 2005 had become the division director of stormwater management where he helped develop and implement the current stormwater utility. He moved to Planning and Development as Deputy Director in 2007. Bryan earned a master's degree in public administration in 2005 from North Georgia State College and University. Bryan and his wife have two sons and live in the Dacula area.

Kathy was born in Geauga County, Ohio, but moved to Georgia with her family in 1968. She presently lives Pendergrass and is married with two children and two grandsons. She worked with Gwinnett County as a Senior Development Review Analyst for 15 years before leaving to start her own consulting business in 1997. After five years in the private sector, Kathy returned to Gwinnett County in February 2002 as the Development Review Manager and was promoted to Division Director in January 2005.

Donna is a registered professional engineer who began working at Gwinnett County in 2000. She has spent the past 10 years doing long-range planning of water and wastewater infrastructure in the Department of Water Resources and has recently been reassigned to the Department of Planning and Development in the efforts to consolidate long range planning activities within the County. She holds a bachelor’s of civil engineering from Georgia Tech and a master’s of public administration from the University of Georgia. Donna resides in the Mountain Park area with her husband.
