GWINNETT SOLICITOR-GENERAL TAKES LEGAL ACTION AGAINST GEORGIA SECRETARY OF STATE, BRAD RAFFENSPERGER, GEORGIA STATE ELECTION BOARD, FOR IMPLEMENTATION OF SB 202

(Lawrenceville, Ga., Sept. 2, 2021) – Gwinnett County Solicitor-General Brian Whiteside filed a complaint on Sept. 2, for injunctive and declaratory relief against Brad Raffensperger, in his official capacity as the Georgia Secretary of State; Rebecca Sullivan, David Worley, Matthew Mashburn and Anh Le in their official capacities as members of the Georgia State Election Board, for the implementation of SB 202.

Section 33 of SB 202, relating to the distribution of food and water to electors, lacks the criminal elements of both intent and harm. An intent to commit a crime with the element of harm cannot be proven in Section 33 of SB 202, therefore it is not prosecutable. The implementation of SB 202 destroys trust in law enforcement and has the potential to cause chaos, riots and possible resisting of arrest at the polls.
