The Georgia open burn ban
takes effect on May 1, 2025, and runs through September 30.

Burn Day Information

In Gwinnett County, outdoor burning of yard debris is prohibited by the Georgia Environmental Protection Division from May 1 to September 30 each year.

Georgia Environmental Protection Division statement:

Beginning May 1, the EPD open burning ban will be in effect for 54 Georgia counties. 
The open burning ban has been in place during the summer ozone season since 2005.

The ban prohibits residents and businesses from burning yard and land-clearing debris during the summer ozone season, which runs from May 1 through September 30.

Recreational and cooking fires are not included in the summer burn ban.

Outdoor Burning Restrictions

The following rules govern all burning, whether a written permit is required or not:

  • No outdoor burning is allowed when the Gwinnett County Fire Marshal’s Office determines that it is a “NO BURN” day due to atmospheric conditions or local circumstances that make outdoor burning hazardous. This information is updated daily by 9:00am and can be found at GwinnettFireMarshal.com or by calling 678.518.4979. If outdoor burning is restricted, the conditions are also listed online.
  • Burning yard debris is prohibited on Sundays and at night. Compliant bonfires, cooking fires, and recreational fires in chimneys and outdoor fireplaces may be used at these times provided all other criteria and restrictions are applied.
  • Fires must be constantly attended by a competent person until extinguished. Equipment capable of extinguishing the fire, such as a garden hose connected to a water supply, must be readily available for use.
  • Burning yard debris is limited to leaves, limbs, etc., that fall on a person’s own property.
  • Burning solid waste and household garbage is prohibited.
  • Burning any material that emits heavy dark smoke (rubber products, oils, roofing material, petroleum-based products, etc.) is prohibited.
  • Burning when smoke presents a health hazard to people in the vicinity of the fire is prohibited. A Medical Burn Ban shall not supersede the exceptions noted by the Georgia Environmental Protection Division and shall be in accordance with the Gwinnett County Fire Prevention and Protection Ordinance.
  • Burning within 20 feet of flammable, combustible, or explosive materials is prohibited unless otherwise specified by the Fire Marshal’s office or by the fire code.
  • The Fire Marshal’s office and Fire and Emergency Services personnel have the authority to summarily abate any conditions which are in violation of any of these provisions, and which may constitute an immediate threat to life and property.

Medical Burn Bans

A Medical Burn Ban may be established by the Fire Marshal to provide relief for citizens with a medical condition that may be adversely affected by smoke from outdoor burning.

Citizens may request a Medical Burn Ban by having their medical doctor complete, sign, and submit the “Medical Burn Ban Application” annually and returning the original form to the Fire Marshal’s Office.

Citizens may request a “Medical Burn Ban application” by contacting our office at 678.518.4980 extension 2, or email FireMarshal@GwinnettCounty.com.

Upon approval of the request, a Medical Burn Ban will be established for a radius of approximately one quarter mile around the intersection nearest the applicants address.

The Medical Burn Ban prohibits the burning of yard debris, commercial pit burns, and related types of burning within the burn ban area. Cooking fires and recreational fires being used safely and in accordance with state and local laws and ordinances are not included in the medical burn ban.

The Medical Burn Ban shall not supersede the exceptions noted by the Georgia Environmental Protection Division and shall be in accordance with the Gwinnett County Fire Prevention and Protection Ordinance. The Medical Burn Ban will be established for a radius of approximately one quarter mile around the intersection nearest the applicants address. The Medical Burn Ban is good thru September 30 of each year. A new one must be requested by the resident annually.
