City of Mulberry Letter of Intent

Notice: Effective January 1, 2025, and pending further direction from the court, the city of Mulberry will be responsible for all planning, zoning, code enforcement, permitting, and business licensing activities within the city limits pursuant to the city of Mulberry’s Letter of Intent. This includes rezonings, special use permits, variances, zoning certifications, code enforcement, building permits, tenant change permits, certificates of occupancy/completion, development permits, sign permits, occupation tax certificates, alcohol licenses, business excise taxes, and any plan reviews or inspections related to these services. All inquiries related to new applications or ongoing projects should be directed to the city of Mulberry.

Check the city of Mulberry map to see if your property or your business are located in the city limits. There is litigation involving the legality of the Mulberry Charter (SB 333) pending before the Georgia Court of Appeals (Hughes v. Gwinnett, et. al., Georgia Court of Appeals, A25A0484) and the Superior Court of Fulton County (Gwinnett County v. State of Georgia, Fulton Superior Court, 24CV012456). The guidance in this notice is subject to change depending upon the outcome of that litigation. All rights are reserved.

Short-Term Rental Task Force Recommendations Report

Short-term rentals are generally understood to be any home or part of a home that is rented for a period of less than 30 days. Over the last decade, the prevalence of short-term rentals has increased significantly, driven by the success of the two major marketplace facilitators Airbnb and VRBO.

The increased number of short-term rentals in Gwinnett has prompted some residents to share concerns with County staff and members of the Board of Commissioners that short-term rentals have driven increased crime, code violations, and a loss of community. In response to these concerns, the Board of Commissioners adopted a resolution on November 14, 2023, establishing the Short-term Rental Task Force with the following responsibilities:

  • Serve as Community Ambassadors
  • Recommend outreach ideas and participate in public forums to gather feedback on short-term rentals
  • Review data from County staff related to housing, the hospitality industry, and short-term rentals
  • Review alternative models and best practices to regulate short-term rentals and address resident concerns
  • Consider approaches to leverage short-term rental housing to provide transitional housing

On January 24, 2025, the final Short-Term Rental Task Force Recommendations Report was formally adopted, and the task force was dissolved effective January 25, 2025, consistent with the establishing resolution adopted by the Board of Commissioners.

Amended Unified Development Ordinance

The Board of Commissioners amended the Official Zoning Map of Gwinnett County in 2024 to create the Gwinnett Place Overlay District and the Satellite Boulevard/Sugarloaf Parkway Suboverlay District within the Civic Center Overlay District.

New Property Maintenance Ordinance

Gwinnett Code Enforcement is enforcing the interior standards of the International Property Maintenance Code at residential rental properties. These new requirements were adopted by the Gwinnett County Board of Commissioners to help maintain a safe, livable, and healthy community.

Tenants can now request an inspection starting by visiting GwinnettZIP.com, calling 770.513.5004, or emailing CodeEnforcement@GwinnettCounty.com. Once a request is submitted, an inspection appointment will be scheduled. During the inspection, any code violations will be documented on a notice of violation. A Gwinnett Code Enforcement officer will then work with the property owner or manager to address all violations. Updated Submittal Requirements for Zoning Applications

The Department of Planning and Development is implementing new requirements for submitting rezoning, change in conditions, and special use permit applications. These requirements include additional site plan standards, building elevations, and pre-application submittal requirements. In addition, the Department of Transportation has established new guidelines for traffic impact studies required as part of the application process. The level of analysis for a traffic impact study is proportional to the size, scope, and trip generation of the proposed development. Applicants will also be required to submit an approved sewer capacity form with most zoning applications. This letter verifies capacity in the public sewer system for new development and redevelopment. Additional details regarding all requirements may be found in the updated Procedures and Instructions document.

For questions related to traffic impact studies, contact the Department of Transportation. Questions related to sewer capacity should be directed to the Department of Water Resources.
