UPDATE: Suspect Shot and Killed Entering Bathroom Window of Snellville Home Identified

July 29, 2016, 4:15pm: Gwinnett County Police are identifying the man who was shot and killed climbing through the window of a Snellville home as 25 year old Michael Silva of Snellville. The suspect lived less than ½ a mile from the incident location. Though it is uncommon for residential burglaries to take place at 4am, detectives believe that Silva’s motive was burglary. The homeowners have been questioned and released and will not face any criminal charges.

July 29, 2016, 7:17am: Gwinnett County Police are investigating the shooting death of a man who climbed through the master bathroom window of a Snellville home and was shot by the homeowner. Shortly before 4am, police responded to the 3500 block of Hadley Place in Snellville. The homeowner told dispatchers that he and his wife were awoken to the sounds of someone entering their home. The husband retrieved his firearm and went to investigate the sounds. When he went into the master bathroom, he discovered a male climbing through the window. At that point, the husband fired one round that struck the suspect in the face.

It appears that the suspect used a ladder to gain access to the window. The homeowner was well within the boundaries of Georgia laws defense of habitation statute. Both the husband and wife have been transported to Gwinnett County Police Headquarters to be questioned by detectives. Crime scene investigators are processing the scene to gather evidence about what took place. The name of the deceased is being withheld pending next of kin notification.
